New York Paid Family Leave Public Health Emergency

Covered Employers: Employers with at least 1 employee on each of at least 30 days in any calendar year.

Employee Eligibility: Employees who have worked at least 26 weeks and have worked more than 20 hours per week. Employees who work less than 20 hours per week must have worked at least 175 days.

Entitlement: The state of New York has announced that their existing New York Paid Family Leave may be available for some employees who are out of work due to COVID-19. This is not a new program, but an expansion of the existing program.

Certification Supporting Need for Leave: The state of New York has made available forms for employees who are out for school closures and childcare unavailability due to COVID-19, and absences related to quarantine or isolation orders due to COVID-19.

Paid: Paid at 60% of the employee's average weekly wage

Benefits: Benefits shall remain intact.

Reinstatement: Employee shall be reinstated to their normal position.

Concurrency

  • May run concurrently with Federal FMLA Public Health Emergency and Federal Paid Sick Leave

  • Ordinarily will never run concurrently with NYDBL; however, for COVID-19-related absences, NY PFL and NY DBL benefits can both be paid at the same time

    • I am caring for an individual subject or advised to quarantine or self-isolate

Eligibility Requirements

  • 20+ hours per week and 26 weeks of employment, or -20 hours per week and 175 days of employment

Length of time provided

  • 10 weeks

Benefit Percentage

  • 60% of AWW in 2020
