Domestic Abuse Leave Act – Minnesota Statute Section 518B.01

Employee Eligibility: All employees
Entitlement: Employers shall not "discharge, discipline, threaten, otherwise discriminate against, or penalize an employee regarding the employee's compensation, terms, conditions, location, or privileges of employment, because an employee took reasonable time off from work to obtain or attempt to obtain an order of protection in a case of domestic abuse."
Employee Notice: Except in cases of imminent danger to the health or safety of the employee or the employee's child, or unless impracticable, an employee who is absent from the workplace shall give 48 hours' advance notice to the employer.
Obligation to Provide Certifications or Documents Supporting Need for Leave: Upon request of the employer, the employee shall provide verification that supports the employee's reason for being absent from the workplace. All information related to the employee's leave pursuant to this section shall be kept confidential by the employer.
Relationship with Other Leave: Note under the Minnesota Sick Leave Benefits; Care of Relatives Act, employees of covered employers (those with 21 or more employees) who have performed work for at least 12 months preceding the request may use personal sick leave benefits for the purposes of providing or receiving assistance because of sexual assault, domestic abuse, or stalking. Covered Employers: Employers with one or more employees
Employee Eligibility: All employees
Entitlement: An employee who is the victim of a crime, or the spouse or next of kin of a victim of a violent crime, or the family member, guardian or custodian or a victim of the victim is a minor, incompetent, incapacitated, or deceased, who is subpoenaed or requested by the prosecutor to attend court for the purposes of giving testimony related to the victim's case, is entitled to take reasonable time off from work to attend criminal proceedings related to the victim's case.
Employee Notice: An employee must give 48 hours' advance notice to the employer, unless impracticable or an emergency prevents the employee from doing so.
Obligation to Provide Certifications or Documents Supporting Need for Leave: Upon request of the employer, the employee must provide verification that supports the employee's reason for being absent from work. The employer must keep confidential all information related to the employee's leave.
