Maryland Crime Victims Leave

Covered Employers: All (employers with at least 1 employee)

Employee Eligibility: No tenure or hours requirement. All employees are eligible and can take this leave if they are the victim of the crime or juvenile delinquent act at issue in the proceeding; the victim's next of kin or guardian when the victim is deceased or disabled; or the victim's representative appointed by the court.

Entitlement: No set amount of time. An eligible employee can take time off from work to comply with a subpoena or other court order, or to attend any relevant proceeding in which the defendant or juvenile has the right to appear, including (but not limited to) a trial or adjudicatory hearing.

Paid?: No.

Reinstatement: Yes. An employer may not deprive an employee of the employee's job solely because of job time lost by the employee as a result of the employee's response to a subpoena requiring the employee to appear as a witness in any civil or criminal proceeding, including discovery proceedings; or the employee's attendance at a proceeding that the employee has a right to attend under § 11-102 or § 11-302 of the Criminal Procedure Article, or under § 3-8A-13 of this article.
