Maryland Adoption leave is not an affirmative right to leave and is an anti-discrimination leave law. Users can choose to remove it from the absence specification.

Covered Employers: All employers in the State that provide paid parental leave following the birth of a child

Employee Eligibility : All employees

Entitlement: An employer who provides leave with pay to an employee following the birth of the employee's child shall provide the same leave with pay to an employee when a child is placed with the employee for adoption.

Employee Notice: Not specified - follow same terms as employer paid parental leave policy.

Obligation to Provide Certifications or Documents Supporting Need for Leave: Yes - follow same terms as employer paid parental leave policy.

Paid: Yes. Note that employees can use Maryland Paid Sick Leave for maternity or paternity leave, and Montgomery County Paid Sick Leave for adoption leave.

Benefits: Must be provided if the employer continues benefits for an employee who takes leave for the birth of a child

Reinstatement: Maryland Adoption leave law does not specifically provide job protected leave
