Indiana Military Leave (Ind. Code §§ 10-17-4-1 et seq., § 10-16-7-6, § 10-16-7-23(d))

Covered Employers: All employers.
Employee Eligibility: All employees.
Entitlement: Eligible employees who are qualified members of the reserve components of the armed forces, members of the Ready Reserve, and members of an organized unit are entitled to a leave of absence for up to fifteen (15) days in a calendar year from a non-temporary position to received military training with the armed forces of the United States. Eligible employees who are reserve members of the United States armed forces are entitled to a leave of absence of up to 15 days per calendar year to attend temporary military training.

Employee Notice: Employees who are qualified members of the reserve components of the armed forces, members of the Ready Reserve, or members of an organized unit must provide their employers with 90 days’ notice of the date of departure and date of return for training. Employees who are reserve members of the United States armed forces must provide their employers notice of the training dates and the need for leave as soon as practicable before the employee’s departure.
Obligation to Provide Certifications or Documents Supporting Need for Leave: Employees must provide evidence of their satisfactory completion of the training.

Benefits: Employees who are qualified members of the reserve components of the armed forces, members of the Ready Reserve, or members of an organized unit will continue to accrue seniority during a leave of absence for military training, and the leave will not affect the employee’s right to receive normal vacation, sick leave, bonus, advancement or other advantages of the employee’s position. For employees who are reserve members of the United States armed forces, a temporary leave of absence does not affect the rights of the employee to vacation leave, sick leave, or other normal benefits of the person’s employment.
Reinstatement: Employees who are qualified members of the reserve components of the armed forces, members of the Ready Reserve, or members of an organized unit are entitled to reinstatement to their former position or a similar position with the same status and pay if they are still qualified to perform the duties of the position. Employees who are reserve members of the United States armed forces are entitled to reinstatement to their former position or a similar position with the same status if they are still qualified to perform the duties of the position.
