Idaho Military Leave (Idaho Code §§ 46-224, 225, Idaho Code § 46-407)
NOTE: This leave will not appear on claims if your organization has chosen not to administer it.
Covered Employers: All employers.
Employee Eligibility: Non-temporary Idaho employees.
Entitlement: Eligible employees who are duly qualified members of the National Guard or of the reserve components of the armed forces, who is a member of an organized unit, may take off up to 15 days per calendar year for military training with the armed forces of the United States Armed Forces.

Employee Notice: Employees must give 90 days’ notice of the need for a leave of absence for temporary military training with departure and return dates.

Benefits: Eligible employees will continue to accrue seniority while on leave. Such absence for military training shall not affect the employee’s right to receive normal vacation, sick leave, bonus, advancement, and other advantages of their employment normally to be anticipated in their particular position.
Reinstatement: Eligible employees who are returning from military leave for training will be returned to their previous position or to a position with the same status, pay and seniority provided (1) evidence of satisfactory completion of military training is provided immediately upon return to work and (2) the employee is still qualified to perform the duties of the job.
Other Important Definitions/Requirements: Eligible employees who are members of the Idaho National Guard and are ordered to duty by the Governor, or eligible employees who are members of the national guard of another state and who are called into active service by the governor of that state, may not be terminated without cause for up to one year following reemployment.
“Duty, other than for training” is any state active duty or federal duty other than training upon the call or order of the governor, or by order of competent federal authority, and does not include weekend drill or annual training as part of normal national guard service, and does not include attendance at military schools.
