Hawaii Organ Donor Act 161 SLH 2014

Covered Employers: Employers with 50 or more employees

Employee Eligibility: 1 year of service

Entitlement: An employer shall provide to an employee leave of absence not exceeding 30 days each calendar year to service as an organ donor. Leave can be taken in one or more periods.

Certification Supporting Need for Leave: Employees may be required to submit written verification to the employer that the employee is an organ donor, and that there is a medical necessity for the donation of the organ.

Reinstatement: Employee is entitled to be reinstated to their position

Paid? Leave is unpaid but employees may elect to use any paid leaves available to them. Employers may require 2 weeks of paid leave to be used.
