Hawaii Bone Marrow or Stem Cell Act 161 SLH 2014

Employer Eligibility: Employers with 50 or more employees

Employee Eligibility: 1 year of service

Entitlement: An employer shall provide to an employee a leave of absence of 7 days each calendar year to serve as a bone marrow donor or peripheral blood stem cell donor. Leave may be taken in one or more periods.

Documentation required: Employees may be required to submit supporting documentation the employee is a bone marrow or peripheral blood stem cell donor, and that there is a medical necessity for such a donation.

Reinstatement to position: Employee is entitled to be reinstated to their position, or to a position with equivalent seniority status, employee benefits, pay, and other terms and conditions of employment.

Paid: Leave is unpaid, but employees may elect to use paid leave. Employers may require an employee to use 3 days of paid leave.
