Colorado Military Leave (Co. Rev. Stat. §§ 28-3-609 - 612)

Covered Employers: All private employers.
Employee Eligibility: Non-temporary Colorado Employees.
Entitlement: Eligible employees who are duly qualified members of the Colorado National Guard are entitled to a leave of absence to perform active state service.
Eligible employees who are duly qualified members of the Colorado National Guard or the reserve forces of the United States may take up to 15 days of unpaid leave per calendar year for military training with the armed forces of the United States.

Benefits: Leave for active state service or training may not affect an employee’s rights to receive normal vacation, sick leave, bonuses, advancement or other advantages of employment that would otherwise be expected for the employee’s particular position.
Reinstatement: Upon return from active state service or military training, employees are entitled to reinstatement to their former position or to a position of like seniority, status and pay, so long as they: (1) provide evidence that service or training was satisfactorily completed; and (2) are still qualified to perform the duties of the position.
