Alaska Crime victims Stat. § 12.61.017, § 12.55.185

Covered Employers: All employers

Employee Eligibility: All employees, if they are the victim of a crime, or if one of these situations applies and the employee is not the perpetrator:

  • The victim is a minor, incompetent, or incapacitated and the employee is their parent, adult child, guardian, custodian, or lives with them in a spousal relationship.

  • The victim is dead and the employee was their parent, adult child, sibling, grandparent, grandchild, or lived with them in a spousal relationship prior to the death.

  • The employee has been legally designated as an interested person.

Entitlement: An employer may not penalize or threaten to penalize a victim of an offense because the victim is subpoenaed or requested by the prosecuting attorney to attend a court proceeding for the purpose of giving testimony, or reports the offense to a law enforcement agency or participates in the investigation of the offense by a law enforcement agency. In this subsection, "penalize" means to take action affecting the employment status, wages, and benefits payable to the victim, including demotion or suspension; dismissal from employment; and loss of pay or benefits, except pay and benefits that are directly attributable to the victim's absence from employment to attend the court proceeding, report the offense to a law enforcement agency, or to participate in a law enforcement agency investigation of the offense.
